These terms cover datary.tech and the Datary application at go.datary.tech, operated by Ali Akbari, Muscat, Sultanate of Oman.
By creating an account you agree to them. If you do not, do not create one.
1. What Datary is
Datary lets a business put a QR code where its customers pay or wait. Customers answer a short survey. The business sees the results in a dashboard.
2. Datary is in beta
Everything currently costs nothing. In exchange, you accept that:
- Features may change or be removed
- The service may be interrupted without notice
- Data may be lost, despite daily backups
- The free period will end at some point
We will give you at least 30 days’ notice by email before we start charging, and before we shut anything down. You will always be able to export or take a copy of your results before either happens.
3. Your account
You need a working email address. Keep your password to yourself — anything done from your account is treated as done by you. Tell us straight away if you think someone else has access.
One account covers one survey. Create a separate account for each branch.
You must be old enough to enter a contract where you live, and you must be acting for a real business.
4. Your questions, your results
The questions you write, your reward text and the responses you collect are yours. We do not sell them, share them with other businesses, or use them to build a product for anyone else.
We store and display them so the service can work, and we may look at aggregate, non-identifying numbers — how many surveys exist, average completion — to improve Datary.
Ask us to delete your account and we delete the account and every response attached to it.
5. Who is responsible for the responses
You decide what to ask your customers and why. In data protection terms you are the controller and Datary is the processor. You are responsible for asking lawfully and for telling your customers what you do with their answers.
Do not use the survey to collect names, phone numbers, ID numbers, health information or payment details. Datary is built for anonymous answers and is not suitable for anything else. If you edit the questions to collect personal details, that is your decision and your responsibility.
6. Rewards are between you and your customer
If you switch rewards on, the reward is a promise you make to your customer. Datary generates a code and tells you whether it has been used. That is all.
We are not party to the offer, we do not fund it, and we are not responsible if a reward is refused, misunderstood, or runs out. Make sure your staff know what you have promised.
7. What you may not do
- Break the law, or help anyone else break it
- Submit fake responses to your own or anyone else’s survey
- Attack, probe, overload or reverse-engineer the service
- Resell Datary as if it were your own product, without a written agreement
- Impersonate another business
- Use it to harass anyone
We may suspend or close an account that does any of this, without notice.
8. Availability
We aim to keep Datary running and we monitor it, but we do not promise any particular uptime during beta. Maintenance, hosting failures and third-party outages happen.
9. Other companies’ services
Datary runs on Hostinger. Written briefings are generated by Groq, and are only produced when you press the button. Those companies have their own terms, and we are not responsible for what they do.
Briefings are generated by a language model. Treat them as a starting point, not as advice. Check anything before acting on it.
10. Ending it
You can close your account whenever you like. We can close or suspend an account that breaks these terms, or stop offering the service entirely with 30 days’ notice.
When an account closes, its data is deleted.
11. No warranty
Datary is provided as it is. We do not promise it will be uninterrupted, error-free, or fit for any particular purpose, and we do not promise that the answers you collect are accurate or representative.
12. Limit of liability
To the extent the law allows, we are not liable for lost profit, lost business, lost data, or any indirect loss.
Since Datary is currently free, our total liability to you is limited to what you have paid us, which is nothing. If you later pay for Datary, our liability is limited to what you paid in the 12 months before the claim.
Nothing here limits liability that cannot be limited by law.
13. Changes
We may update these terms. The date at the top will change, and we will email account holders about anything material. Continuing to use Datary means you accept the new version.
14. Law
These terms are governed by the laws of the Sultanate of Oman. Disputes go to the competent courts of Muscat.
